IS8 Terms and Agreements

Please read these terms carefully before using IS8 Web Directory. By accessing or using this platform, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing, browsing, or using IS8 Web Directory (the "Directory" or "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Agreements ("Terms"). If you do not agree to these Terms, you must immediately cease using the Directory.

We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Directory after any modification constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically for changes.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and the operators of IS8 Web Directory ("we," "us," or "our").

2. Definitions

For purposes of these Terms:

• "Directory" or "Platform" refers exclusively to the IS8 Web Directory website and does not include any third-party websites linked from or listed within the Directory.
• "Content" refers to all information, text, images, data, descriptions, categories, rankings, scores, and materials displayed on the Directory.
• "Listings" or "Entries" refers to informational directory entries about websites, designs, digital experiences, designers, brands, studios, or their work. Listings are informational displays and do not constitute offers to sell, endorsements, certifications, or guarantees of any kind.
• "Listed Parties" refers to any designers, brands, studios, agencies, companies, or individuals whose work, websites, or information appears in the Directory, who are independent of and not affiliated with us unless expressly stated.
• "Listed Websites" refers to external third-party websites that appear as entries in the Directory. These websites are owned and operated by Listed Parties, and we have no control over their content, availability, performance, or practices.
• "Users" or "Visitors" refers to any individual or entity accessing or using the Directory in any manner.
• "Merit Points" refers to points accumulated by Listed Parties through meritocratic achievement, which may be used within the Directory's recommendation system as described herein.
• "Meritocratic Evaluation" refers to the jury-based evaluation process through which entries are assessed, scored, and ranked based on predetermined criteria.
• "Grand Jury" refers to the international body of evaluators who assess entries submitted for meritocratic evaluation.
• "A' Design Award" refers to A' Design Award and Competition S.r.l. and its affiliates.

3. Nature of the Directory

IS8 IS AN INFORMATIONAL WEB DIRECTORY ONLY.

We compile, curate, organize, and display information about websites, designs, digital experiences, and the creative professionals and brands behind them. The Directory is organized according to meritocratic achievement as determined through jury-based evaluation. We are:

• An informational directory that organizes and displays entries about websites and designs
• A curated reference resource based on meritocratic evaluation

We are not:

• A retailer, seller, or provider of any products or services
• A broker, agent, intermediary, or marketplace operator
• A party to any transaction between Users and Listed Parties
• An escrow service, payment processor, or fulfillment provider
• A certification body, standards organization, or quality assurance entity
• An endorser of any Listed Party, website, product, service, or brand
• A guarantor of the quality, safety, availability, or performance of any listed website, product, or service
• A mediator or arbiter of disputes between Users and Listed Parties

We do not sell anything. The Directory provides information about websites and designs. Any external link directs Users to a third-party website entirely outside our control. Any interaction, transaction, or engagement that occurs after leaving the Directory is solely between the User and the third party.

Listings are informational directory entries. The presence of a listing does not mean the listed website is currently active, that the Listed Party is currently in business, that any product or service described is available, or that the Listed Party will respond to contact attempts.

4. Directory Content and Curation

Curated Directory: IS8 Web Directory is a curated directory. Entries are organized, categorized, and ranked based on meritocratic achievement. Curation involves editorial and evaluative judgment. Curation does not constitute endorsement, certification, or guarantee of quality.

Curation Does Not Equal Verification: While entries in the Directory are selected and organized through a meritocratic evaluation process, curation does not mean we have verified the accuracy of any information displayed, confirmed the current operational status of any listed website, tested any product or service described, validated any claims made by Listed Parties, confirmed the identity or credentials of any Listed Party, or inspected, audited, or assessed any Listed Party's business operations.

Directory Organization Is Informational: The organization, categorization, and ranking of entries serve an informational and navigational purpose. The position of any entry within the Directory reflects evaluation scores and is provided as informational context. It does not constitute a recommendation to visit, engage with, purchase from, or rely upon any Listed Party.

Content May Change: Directory content, including listings, categories, rankings, and organizational structure, may change at any time without notice. We have no obligation to maintain any particular content, structure, or listing.

5. Meritocratic Evaluation and Ranking

Evaluation Process: Entries in the Directory may be evaluated by an international grand jury against predetermined criteria. Evaluation criteria may encompass dimensions such as design quality, innovation, usability, communication effectiveness, and other factors determined at our sole discretion. The specific criteria, their weighting, and the evaluation methodology may change at any time without notice.

Jury Composition: The composition, size, and membership of the grand jury are determined at our sole discretion and may change from evaluation cycle to evaluation cycle. We make no representation regarding the qualifications, expertise, independence, or judgment of any individual juror.

Scores and Rankings: Evaluation scores and the resulting rankings reflect the collective assessment of the jury at the time of evaluation. Scores and rankings are provided for informational and organizational purposes. They do not constitute guarantees of quality, certifications of excellence, endorsements, or recommendations. Evaluation outcomes are inherently subjective and reflect the judgment of the particular jury at the particular time of evaluation.

No Guarantee of Evaluation Accuracy: We do not guarantee that evaluation scores or rankings accurately reflect the quality, merit, or value of any entry. Evaluation involves subjective judgment and may be influenced by factors beyond our control. Scores may contain errors. Rankings may not reflect current quality, as websites and designs may change after evaluation.

Right to Modify Evaluation System: We reserve the right to modify, replace, or discontinue the evaluation system, criteria, methodology, jury composition, scoring system, ranking methodology, or any aspect of the meritocratic evaluation process at any time, at our sole discretion, without notice or liability.

Evaluation Results Are Final: All evaluation results, scores, rankings, and award determinations are final and are not subject to appeal, review, or challenge through these Terms or any other process administered by the Directory.

6. Merit Points and Recommendation Pathway

Merit Points System: Listed Parties who achieve recognition through meritocratic evaluation may accumulate merit points proportional to their demonstrated achievement. These points may be used to create or recommend additional directory entries through the recommendation pathway.

Points Are Not Property: Merit points are not property, currency, or assets. They are a functional mechanism within the Directory's system. Points have no monetary value, cannot be sold, transferred, assigned, or exchanged, cannot be redeemed for cash or any other consideration, may be modified, adjusted, revoked, or expired at our sole discretion, and do not create any right, entitlement, or claim against us.

Recommended Entries: Entries created through the recommendation pathway are subject to the same disclaimers as all other entries. Recommendation by a meritocratic achiever does not constitute endorsement by the Directory, guarantee of quality, verification of any information, or any warranty of any kind.

Right to Modify Points System: We reserve the right to modify, adjust, reset, revoke, or discontinue the merit points system, point values, point allocation, point expiration, or any aspect of the recommendation pathway at any time, at our sole discretion, without notice or liability.

No Guarantee of Recommendation Acceptance: The possession of merit points does not guarantee that any recommended entry will be accepted, published, or maintained in the Directory. All entries, including recommended entries, are subject to our sole discretion regarding inclusion.

7. Listing Inclusion, Refusal, and Removal

Sole Discretion: All decisions regarding the inclusion, positioning, modification, or removal of any listing are made at our sole and absolute discretion. We are under no obligation to include any entry in the Directory, maintain any entry in the Directory, provide reasons for refusing or removing any entry, offer any appeals process, compensate any party for refusal or removal, or treat any submission or recommendation equally.

Right to Refuse: We may refuse any listing for any reason, including reasons related to quality standards, editorial judgment, legal concerns, reputational considerations, category appropriateness, technical requirements, or any other factor we deem relevant, as well as for no stated reason whatsoever.

Right to Remove: We may remove any existing listing at any time without notice. Removal may occur for any reason or for no reason. Removal does not entitle any party to compensation, explanation, or reinstatement.

Right to Modify: We may modify any listing's content, position, ranking, category, description, or any other attribute at any time without notice or consent from the Listed Party.

No Entitlement to Listing: No party has any right, entitlement, or expectation of being listed in the Directory. Participation in the A' Design Award or any other competition does not entitle any party to a listing. Possession of merit points does not entitle any party to a listing. Previous inclusion does not entitle any party to continued inclusion.

No Liability for Listing Decisions: We accept no liability for any loss, damage, or consequence arising from any decision to include, refuse, modify, reposition, or remove any listing, including any alleged loss of visibility, reputation, business opportunity, or revenue.

8. Comprehensive Warranty Disclaimer

• Any warranty of merchantability
• Any warranty of fitness for a particular purpose
• Any warranty of non-infringement
• Any warranty of accuracy, completeness, or reliability of any information
• Any warranty of timeliness or currency of any listing or content
• Any warranty of availability or uninterrupted access to the Directory
• Any warranty of error-free or secure operation
• Any warranty that listed websites are active, functional, or accessible
• Any warranty that Listed Parties are currently in business or operational
• Any warranty that Listed Parties will respond to contact attempts
• Any warranty that any product or service described is available or as described
• Any warranty that evaluation scores or rankings accurately reflect quality or merit
• Any warranty that any Listed Party currently holds or ever held any award
• Any warranty that any listed website, product, or service is of any particular quality
• Any warranty that any listed website is safe, secure, or free from malicious content
• Any warranty that directory categories or classifications are accurate
• Any warranty that external links are functional or lead to intended destinations
• Any implied warranties arising from course of dealing or usage of trade
• Any warranties created by any statement, representation, or conduct

If any warranty cannot be disclaimed under applicable law, such warranty is limited to the minimum period and scope permitted by law.

9. Limitation of Liability

This includes but is not limited to:

• Any direct, indirect, incidental, special, consequential, punitive, or exemplary damages
• Any loss of profits, revenue, business, goodwill, data, or use
• Any personal injury or property damage
• Any other losses or damages of any kind

Arising from or related to:

• Use or inability to use the Directory
• Any content, listing, ranking, or information in the Directory
• Any evaluation score, ranking position, or award status displayed
• Any visit to any listed website or any external website linked from the Directory
• Any interaction, transaction, or engagement with any Listed Party
• Any product purchased or service obtained from any Listed Party or third party
• Any communication with any Listed Party
• Any failure of any Listed Party to respond or perform
• Any defect in any product or service offered by any Listed Party
• Any injury or damage caused by any product or service
• Any misrepresentation, fraud, or misconduct by any Listed Party
• Any reliance on any information, score, ranking, or award status displayed
• Any error, omission, or inaccuracy in any listing or content
• Any unauthorized access to or alteration of the Directory
• Any malicious content, viruses, or security threats encountered on listed websites
• Any decision to include, refuse, modify, or remove any listing
• Any modification to evaluation criteria, scores, rankings, or the merit points system
• Any conduct of any third party
• Any other matter relating to the Directory

This limitation applies regardless of the legal theory asserted (contract, tort, negligence, strict liability, or otherwise), whether we were advised of the possibility of such damages, and whether such damages were foreseeable.

Maximum Liability Cap: If, notwithstanding the foregoing, we are found liable for any reason whatsoever, our total aggregate liability shall not exceed the greater of (a) ten euros (€10.00) or (b) the total amount you paid us in the twelve months preceding the claim.

10. External Websites and Outbound Links

Directory Links to External Websites: The primary function of IS8 Web Directory is to organize and present information about websites and designs with links to external websites. When you click any link, button, or call-to-action within a listing, you leave the Directory and are redirected to an external third-party website entirely outside our control.

External Websites Are Independent: Listed websites and all other external websites linked from the Directory are independently owned, operated, and maintained by third parties. We have no control over, and accept no responsibility for, the content, accuracy, legality, or appropriateness of any external website; the privacy practices or data collection of any external website; the security, safety, or availability of any external website; any products or services offered on any external website; any transaction conducted on any external website; any terms, conditions, or policies of any external website; or any experience, loss, or damage arising from visiting any external website.

Websites Change: External websites may change at any time after being listed in the Directory. A listed website may have been modified, redesigned, or replaced since its evaluation; may now contain content different from what was evaluated; may have changed ownership; may have become inactive, broken, or non-functional; may now redirect to a different website; may now contain malicious content, malware, or security threats; or may now violate applicable laws or regulations. We have no obligation to monitor listed websites for changes and accept no liability for any change to any listed website after its inclusion in the Directory.

Call-to-Action Buttons and Links: The Directory may display various call-to-action buttons and links including "Visit Website," "Learn More," "View Project," "Contact," "Hire," and similar prompts. These buttons redirect Users to external websites. Button labels describe the general intended action and do not guarantee that the destination website is active or functional, that the Listed Party will respond, that any described product or service is available, or that the experience on the external website will meet any expectation.

Linking Does Not Constitute Endorsement: The inclusion of any link in the Directory does not constitute endorsement, recommendation, approval, or verification of the linked website, its operator, or its content.

11. Award Information Disclaimer

Award Status Based on Third-Party Records: Information regarding award status displayed in the Directory is derived from records of design competitions including the A' Design Award and Competition. This information is provided for informational and organizational purposes.

No Guarantee of Award Status: We do not guarantee that any Listed Party currently holds or ever held any award. Award records may contain errors. Award status may have been revoked, expired, or incorrectly recorded. We do not independently verify all award claims on an ongoing basis.

Award Status Is Informational Context: The display of award information provides context for the Directory's meritocratic organization. It does not constitute endorsement of any Listed Party; guarantee of quality, safety, or reliability; certification or accreditation; recommendation to engage, purchase, or rely upon any Listed Party; or verification of any claim made by any Listed Party.

Recognition of Design Merit Is Distinct from Commercial Suitability: Recognition in a design competition reflects design merit as assessed at a specific point in time. It does not indicate commercial reliability, business integrity, financial stability, ongoing quality, suitability for any particular purpose, or willingness or ability to engage with the public.

12. Enhanced A' Design Award Protection

A' Design Award as Listing Partner: A' Design Award and Competition S.r.l. ("A' Design Award") may create listings in the Directory for designers, brands, and studios that have received recognition in its competitions. These listings are created as a promotional benefit for award recipients, based on information from competition submissions, to increase visibility of recognized designs, and in good faith based on available information.

A' Design Award Acts in Good Faith: When A' Design Award creates listings, it does so based on information provided during competition entry. Such information may have been accurate at the time of submission but may have subsequently changed. A' Design Award does not verify current accuracy of all listing details on an ongoing basis, does not confirm commercial availability of any design, and does not contact Listed Parties for approval of each individual listing. A' Design Award creates listings as a promotional service, and this service does not constitute a guarantee of any kind.

A' Design Award Makes No Warranties: A' Design Award makes no warranty or representation that Listed Parties wish to be contacted, that Listed Parties are currently in business, that Listed Parties will respond to inquiries, that any listed website is active or functional, that any product or service is available, that any information in any listing is current or accurate, or that any Listed Party endorses or approves its listing.

A' Design Award Disclaims All Liability: A' Design Award expressly disclaims any and all liability for any listing it creates in the Directory, any error or omission in any listing, any outdated or inaccurate information, any failure of Listed Parties to respond or perform, any interaction or transaction between Users and Listed Parties, any damages arising from reliance on listing information, any experience on any listed external website, or any claim that a listing should or should not exist.

No Claim Against A' Design Award: Users agree they shall not make any claim against A' Design Award arising from or related to any listing in the Directory, any information in any listing, any evaluation score or ranking, any conduct or failure of any Listed Party, any interaction or transaction with any Listed Party, any reliance on any listing or award information, or the existence, non-existence, inclusion, or removal of any listing.

Competition Recognition Does Not Create Commercial Obligations: Users acknowledge that recognition in a design competition administered by A' Design Award does not mean the design is commercially available, does not mean the designer offers services to the public, does not mean the designer wishes to be contacted, does not obligate the designer to engage with inquiries, does not create any commercial relationship, and constitutes recognition of design merit only.

13. Listed Party Information and Accuracy

Information Provided by Third Parties: Listing information, including descriptions, images, credentials, contact details, website URLs, and other content, may be provided by Listed Parties, by partners including A' Design Award, or generated from publicly available records. We do not independently create, verify, validate, test, confirm, or approve the accuracy of listing information.

Information May Be Outdated: Information displayed in the Directory may have been accurate when originally compiled and may no longer be current. Websites change, businesses evolve, contact information becomes outdated, and designs may be updated or discontinued. We have no obligation to update any listing and accept no liability for outdated information.

Descriptions Are Informational: All descriptions of designs, websites, products, services, capabilities, and achievements are informational summaries. They may be incomplete, simplified, or based on information that has changed since the listing was created.

Users Must Verify: Users must independently verify all information directly with Listed Parties before making any decision based on Directory content. The Directory is a starting point for discovery, and reliance on any listing information without independent verification is at the User's sole risk.

14. Partner-Created and Auto-Generated Listings

Listings May Be Created by Partners: Some listings in the Directory may be created by partners, including A' Design Award, rather than by the Listed Parties themselves. Such listings may be created to promote recognized designs, based on publicly available competition records, without the direct involvement or awareness of the Listed Party, as a promotional service to competition participants, and through automated or semi-automated processes.

Listed Parties May Not Have Created or Approved Their Listing: Listed Parties appearing in the Directory may not have requested their listing, may not have provided the information displayed, may not have approved the listing content, may not be aware that their listing exists, may not have verified any information shown, and may not endorse how they are presented in the Directory.

Auto-Generated Content: Some listings may be automatically generated from competition databases, public records, partner data feeds, or aggregated information sources. Such auto-generated listings may contain placeholder content, generic descriptions, incomplete or outdated information, and errors or inaccuracies inherent to automated processes.

No Verification of Auto-Generated Listings: Auto-generated and partner-created listings are not individually verified for accuracy, currency, or completeness. They are provided for informational purposes and may require significant correction or updating. We accept no liability for any inaccuracy in auto-generated or partner-created content.

15. No Obligation of Listed Parties

No Obligation to Respond: Listed Parties are under no obligation to respond to any contact attempt, acknowledge any inquiry, provide any information, engage in any communication, or explain their non-response.

No Obligation to Provide Products or Services: Listed Parties are under no obligation to sell any product, provide any service, accept any client or project, submit any proposal, be available for hire, license any intellectual property, or offer anything to the public.

Reasons Parties May Not Engage: Listed Parties may not respond or may decline to engage because they did not create or authorize the listing, they are unaware of the listing, they no longer offer the described product or service, they have ceased business operations, they are not accepting new work, they do not serve the User's market or region, the listing was created in error, the design was a concept or prototype never commercialized, contact information is outdated, the company or individual no longer exists, or for any other reason.

User Accepts Risk of Non-Response: Users acknowledge and accept that contacting a Listed Party may result in no response, and that this is a normal and expected possibility for which the Directory bears no responsibility.

16. Visual and Image Disclaimers

Images Are Representative: All images displayed in the Directory are representative and may not accurately depict current websites, products, services, or designs.

Specific Image Disclaimers: Images may show websites as they appeared at the time of evaluation, which may have since changed; display screenshots that no longer reflect current website content or design; be digitally enhanced, cropped, or modified; show prototypes, concepts, renderings, or competition submissions rather than live websites or commercial products; be AI-generated or computer-rendered; show scale, colors, or proportions inaccurately; or be outdated in any other respect.

No Reliance on Images: Users should not rely on images to make any decision without independently verifying current conditions by visiting the actual listed website or contacting the Listed Party directly.

17. Platform Intellectual Property Rights

Our Intellectual Property: The Directory, including its design, layout, graphics, logos, icons, code, software, text, compilation of listings, organizational structure, categorization system, ranking methodology, and overall look and feel, is protected by intellectual property laws and is owned by or licensed to us.

Trademarks: "IS8" and associated logos are trademarks. "A' Design Award" and related marks are trademarks of A' Design Award and Competition S.r.l. All other trademarks appearing in the Directory are the property of their respective owners and are displayed for identification purposes.

Limited License: Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Directory for personal, non-commercial purposes in accordance with these Terms. This license does not include any right to copy, reproduce, or redistribute Directory content; any right to use data mining, scraping, or extraction tools; any right to create derivative works; any commercial use rights; or any rights not expressly granted.

Reservation of Rights: All rights not expressly granted are reserved.

18. Intellectual Property Disclaimers

No Verification of Third-Party IP Rights: We do not verify that any Listed Party owns, has rights to, or is authorized to use any intellectual property displayed in connection with their listing. We make no representation regarding intellectual property ownership, validity, or enforceability.

IP Disputes Between Third Parties: Any intellectual property dispute regarding listed content is between the relevant parties. We are not responsible for any infringement claim and have no obligation to adjudicate intellectual property disputes.

User Assumes IP Risk: Users who license, acquire, or engage with intellectual property through contact with Listed Parties assume all risk regarding the validity, ownership, and enforceability of such intellectual property.

19. User Conduct and Prohibited Uses

Permitted Use: The Directory is provided for personal, non-commercial informational purposes: to discover and learn about recognized designs, websites, and creative professionals, and to potentially visit listed websites or contact Listed Parties.

Prohibited Activities: Users shall not use the Directory for any unlawful purpose; scrape, mine, harvest, or systematically collect data from the Directory; use automated tools, bots, crawlers, or scripts to access the Directory except with our express written permission; copy, reproduce, or redistribute Directory content in any medium; create derivative works from Directory content; use Directory data to build competing products, services, or directories; interfere with or disrupt Directory operations or infrastructure; attempt to gain unauthorized access to any systems; circumvent any security or access-control measures; impersonate any person or entity; submit false or misleading information; use the Directory to transmit spam, malicious content, or unsolicited communications; engage in any activity that damages our reputation or the reputation of the Directory; reverse-engineer, decompile, or disassemble any aspect of the Directory; or use the Directory in any manner that violates these Terms.

Enforcement: We reserve the right to investigate violations and take appropriate action including removing content, blocking access, terminating usage rights, and pursuing legal remedies.

20. User Responsibilities and Acknowledgments

By using the Directory, Users acknowledge and agree that they have read and understood these Terms in full; they use the Directory entirely at their own risk; they will conduct independent due diligence before any engagement with any Listed Party; they will independently verify all information before reliance; they will not hold us responsible for the conduct, products, services, or websites of any Listed Party; they understand the Directory provides information only; they understand we do not sell, broker, or facilitate any transaction; they will comply with all applicable laws in their jurisdiction; they will resolve any dispute with Listed Parties directly with those parties; they are of legal age to enter binding agreements; and they accept that evaluation scores, rankings, and award information are provided as informational context and do not constitute quality guarantees.

User's Sole and Exclusive Remedy: User's sole and exclusive remedy for any dissatisfaction with the Directory is to stop using it.

21. Data Shared with Third Parties

Data in Inquiries: When Users contact Listed Parties through external links, email addresses, contact forms, or other contact information displayed in the Directory, Users provide personal data directly to those third parties. We do not control how Listed Parties or any third parties use such data, are not responsible for their data practices, encourage Users to review the privacy policies of any third party they contact, and accept no liability for any third party's handling of User data.

No Data Controller Responsibility for Third Parties: We are not the data controller for any information Users provide directly to Listed Parties or other third parties through external links or contact information.

22. Indemnification

Users agree to indemnify, defend, and hold harmless the Directory, its owners, operators, affiliates, partners, licensors, service providers, employees, agents, officers, directors, jurors, evaluators, and related parties (including A' Design Award and Competition S.r.l. and all its affiliates, officers, directors, and employees) from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• User's use of the Directory
• User's violation of these Terms
• User's violation of any applicable law or regulation
• User's violation of any third-party rights
• Any interaction or transaction between User and any Listed Party or third party
• Any dispute between User and any Listed Party or third party
• Any content, data, or information User submits
• User's reliance on any Directory content, listing, score, or ranking
• Any claim that User's actions caused damage to a third party
• Any unauthorized use of the Directory by the User

This indemnification obligation survives termination of these Terms and the User's cessation of use of the Directory.

23. Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to conflict of law principles.

Exclusive Jurisdiction: Any dispute arising from or relating to these Terms or use of the Directory shall be subject to the exclusive jurisdiction of the courts of Como, Italy.

Waiver of Class Action: To the extent permitted by applicable law, Users waive any right to participate in class actions, collective actions, or representative proceedings. All claims must be brought individually.

Time Limitation: Any claim arising from or related to these Terms or the Directory must be filed within one (1) year after the claim arose, or be permanently barred.

Mandatory Informal Resolution: Before initiating any legal proceeding, Users must attempt to resolve disputes informally by contacting us. Users agree to negotiate in good faith for at least sixty (60) days before filing any claim.

24. Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights, except that A' Design Award and Competition S.r.l., its parent companies, subsidiaries, and affiliates, its officers, directors, employees, and agents, our affiliates, partners, and service providers, grand jury members and evaluators, and any other indemnified parties are express third-party beneficiaries of the indemnification, limitation of liability, and disclaimer provisions and may enforce such provisions directly.

25. Injunctive Relief

Notwithstanding any other provision, we shall be entitled to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent violation of our intellectual property rights or these Terms, without need to post bond or demonstrate irreparable harm beyond the violation itself.

26. Feedback and Submissions

Feedback Becomes Our Property: Any feedback, suggestions, ideas, listing corrections, or other submissions provided to us become our property. We may use such submissions for any purpose without compensation or attribution to the User.

No Obligation to Act: We have no obligation to review any feedback, implement any suggestion, make any correction, respond to any submission, or maintain confidentiality of any submission.

No Confidential Relationship: Submitting feedback or information does not create any confidential, fiduciary, or other special relationship.

27. Listed Party Requests

Removal Requests: Listed Parties who wish to request modification or removal of their listing may contact us. We will review such requests in good faith. However, we are under no obligation to comply with any request, may take reasonable time to process requests, reserve the right to maintain listings based on publicly available information, and accept no liability for any delay in processing requests.

Correction Requests: Listed Parties may request corrections to listing information. We may, at our discretion, make requested corrections, request verification of claimed corrections, decline to make corrections, or make corrections on our own timeline.

No Guarantee of Response Time: We do not guarantee any particular response time for Listed Party requests. Processing times may vary based on volume, complexity, and available resources.

28. Accessibility

Accessibility Efforts: We endeavor to make the Directory accessible, though we do not guarantee compliance with any particular accessibility standard or specification.

No Warranty of Accessibility: We make no warranty that the Directory is fully accessible to all users or compatible with all assistive technologies. Users who experience accessibility barriers are encouraged to contact us.

29. Technical and Security Disclaimers

No Guarantee of Availability: The Directory may be unavailable at any time due to maintenance, technical failures, cyber attacks, force majeure events, or any other reason. We do not guarantee uptime, availability, or performance.

Browser and Device Compatibility: The Directory may not function correctly on all browsers, devices, or operating systems. We do not guarantee compatibility with any particular technology configuration.

Security: While we implement reasonable security measures, we cannot guarantee that the Directory is free from vulnerabilities, that unauthorized access will not occur, that data transmissions are completely secure, or that the Directory is free from viruses or malicious code.

Data Loss: We are not responsible for any data loss, corruption, or unauthorized access resulting from use of the Directory.

30. Translations and Language

English Prevails: These Terms are drafted in English. Any translation is for convenience only. In case of conflict between the English version and any translated version, the English version prevails.

Translation Errors: We are not responsible for errors, ambiguities, or misinterpretations in any translated version of these Terms or Directory content.

31. General Provisions

Severability: If any provision of these Terms is found invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. All remaining provisions continue in full force and effect.

Entire Agreement: These Terms constitute the entire agreement between Users and the Directory regarding use of the Directory, superseding all prior agreements, representations, negotiations, and understandings, whether written or oral.

No Waiver: Our failure to enforce any provision at any time does not constitute waiver of that provision or any other provision, and does not limit our right to enforce that provision in the future.

No Agency: Nothing in these Terms creates any agency, partnership, joint venture, employment, or fiduciary relationship between Users and the Directory, between the Directory and any Listed Party, or between Users and any Listed Party.

Assignment: Users may not assign or transfer these Terms or any rights under these Terms. We may assign these Terms without restriction and without notice.

Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, network failures, power outages, or any other force majeure event.

Headings: Section headings are for convenience and reference only and have no legal or contractual effect.

Survival: All provisions regarding disclaimers, limitations of liability, indemnification, intellectual property, dispute resolution, and any other provisions that by their nature should survive, shall survive termination of these Terms and cessation of use of the Directory.

32. Modifications and Termination

Right to Modify Terms: We reserve the right to modify these Terms at any time without prior notice. The most current version will always be available on the Directory. Continued use of the Directory after any modification constitutes acceptance of the modified Terms.

Right to Modify or Discontinue the Directory: We may, at any time and without notice or liability, modify, suspend, or discontinue the Directory in whole or in part; add, remove, modify, or reposition any listing, category, feature, or content; change the evaluation system, criteria, scoring, or ranking methodology; modify or discontinue the merit points system; restrict or terminate access for any User; or take any other action regarding the Directory at our sole discretion.
